Please read these terms carefully. By creating an account or using Kestrel, you agree to be bound by these Terms of Service.

1. Who We Are

Kestrel is developed and operated by Lockard Labs LLC ("Lockard Labs," "we," "us," or "our"), a limited liability company. You can reach us at [email protected].

2. What Kestrel Is

Kestrel is a caregiver-facing seizure and medication logging app. It is a tool for recording and organizing health information — it is not a medical device, does not provide medical advice, and is not a substitute for professional medical care. Always consult a qualified healthcare provider regarding medical decisions.

3. Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age. Kestrel is designed to be used by adults on behalf of individuals in their care — not by minors directly.

4. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

You may not share your account with others. You may, however, invite caregivers within the app using the built-in caregiver invitation feature.

5. Acceptable Use

You agree not to:

Use Kestrel for any unlawful purpose or in violation of any applicable law or regulation.
Attempt to gain unauthorized access to any part of the service or its underlying systems.
Reverse engineer, decompile, or otherwise attempt to extract the source code of the app.
Use the service to store or transmit content that is illegal, harmful, or violates the rights of others.

6. Your Data

You retain ownership of all health and personal data you enter into Kestrel. By using the service, you grant Lockard Labs a limited license to store and process that data solely to operate the app for you. We will never sell your data or use it for advertising. You are responsible for the accuracy of the data you enter. We do not verify clinical accuracy of log entries.

7. Subscription and Billing

Kestrel currently offers a free tier. Paid features, if and when offered, will be clearly disclosed before any charge is made. We reserve the right to introduce, change, or discontinue pricing with reasonable notice to existing users.

8. Availability and Changes

We strive to keep Kestrel available and reliable, but we do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. For material changes that affect your data, we will provide reasonable advance notice.

9. Disclaimer of Warranties

Kestrel is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free or that data will never be lost.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Lockard Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Kestrel, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Washington State.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the app before the changes take effect. Continued use of Kestrel after the effective date of updated Terms constitutes your acceptance of the new Terms.
